Algemene verkoopvoorwaarden

The general conditions of sale govern the sale of stays and are valid at the time the reservation is made. Booking a stay at Côté Ô Villages & Clubs implies full acceptance of these general conditions.

1. Booking conditions
The reservation becomes effective only with the agreement of Côté Ô Villages & Clubs. A reservation confirmation is sent to the customer, by email, upon receipt of the deposit. The general conditions of sale are deemed to have been acquired when booking on the Côté Ô website or after receipt of the booking confirmation.
By booking accommodation, the customer acknowledges having read and accepted these general conditions. The acceptance of these general conditions can only be full and complete. Any conditional subscription is considered void and invalid. These general conditions of sale are up to date as soon as they are published online and cancel and replace any previous version. These general conditions as well as the booking confirmation sent to the customer form the stay contract and constitute the entire contractual relationship between the parties.
Reservations are binding on Côté Ô Villages & Clubs, only if Côté Ô Villages & Clubs has accepted them, which Côté Ô Villages & Clubs is free to do or refuse, depending on availability, and in general, all circumstances likely to affect the execution of the reservation made. Côté Ô Villages & Clubs offers family holidays, in the traditional sense, the accommodation is specially designed for this purpose. Côté Ô Villages & Clubs reserves the right to refuse any reservation which would be contrary to this principle, or which would seek to divert it.
The reservation of a campsite or a rental is made on a strictly personal basis. The reservation may in no case be the subject of a sublet, or of a transfer without the prior consent of Côté Ô Villages & Clubs. Minors must be accompanied by their parents or legal guardians.

For a 1-bedroom rental, the maximum capacity is 2 people, for a 2-bedroom rental: 4 people, for a 3-bedroom rental: 6 people (sometimes 7, depending on the campsites and categories of mobile- homes), for a 4-bedroom rental: 8 people, and for a 5- bedroom rental: 10 people.
Each person is counted in the reservation, including children and infants under 2 years old.
For pitches: the basic package includes the pitch for the tent, caravan, or camper van for 2 people, access to sanitary facilities and reception facilities. A maximum of 6 people is authorized, per pitch.
Côté Ô Villages & Clubs campsites reserve the right to refuse access to the campsite, to groups or families with a number of participants more important than the capacity of the rented accommodation.

Definition of the Price
The prices do not include:
– Rental of sheets (except for the Prestige and Prestige SPA ranges)
– Cancellation insurance
– Application fees of a fixed amount of 35€
– Paid activities offered by each campsite
– Taxes (tourist taxes / eco-participation / local taxes …)
– The deposit
– Additional services (Wi-Fi, drinks, catering, amusement parks, shuttle services, additional places, etc.).
The availability of all these additional services cannot be guaranteed by Côté Ô Villages & Clubs. The customer must inquire at the reception to know the available services and their pricing conditions.
Prices include :
– water, gas, and electricity
– Reception and inventory
– Services and equipment Côté Ô Villages & Clubs, except for paid or optional ones.
The rate applicable to the stay is the rate in effect on the day of the reservation, subject to availability. When the customer requests an estimate, the validity of the latter is indicated on the estimate. After the validity date, the price indicated on the estimate is no longer guaranteed.
Subject to the provisions of Article L211-17-2 of the Tourism Code, in the event of a manifest error in the published price, such as a derisory price compared to the average of prices recorded for the same stay at the same period, the customer is informed that the contract is deemed null and that he will be refunded his deposit, or the total price paid without compensation.
Prices are subject to change during the season.

The advantages and promotions offered by Côté Ô Villages & Clubs after the reservation date are not retroactive.

2. Cancellation and modification
Modification of reservation
Any modification of stay must be the subject of a written request and is subject to the agreement of Côté Ô Villages & Clubs, to the extent of availability and possibilities. No postponement will be accepted for the following season. In the absence of modification, the customer must make his stay under the initial booking conditions or cancel it according to the cancellation conditions. Any request to increase the length of your stay will be made according to availability and rates in force at the time of the request. Any request to reduce the length of stay is considered a partial cancellation and will be subject to the terms of cancellation and interruption of stay.

Cancellation by Côté Ô Villages & Clubs
In the event of cancellation by Côté Ô Villages & Clubs, except in cases of force majeure, the stay will be fully refunded. This cancellation may not, however, give rise to the payment of damages.

Cancellation by the customer
All reservations are considered firm. In the event of cancellation, Côté Ô Villages & Clubs reserves the right to retain all sums paid. The customer can, if he wishes, take out cancellation insurance or a peace of mind option.
Any interrupted or shortened stay (late arrival, early departure) by the customer, will not give rise to a refund.
If the tranquility option was taken out when booking, the customer benefits from flexible conditions for canceling the stay:
• Up to 15 days before arrival: refund of sums paid minus the tranquility option
• From 15 days before arrival: No refund can be made.

3. Group reservation
Any reservation, for more than 4 accommodations, by the same person or by different persons but knowing each other and traveling together for the same reasons on the same dates of stay on the same Côté Ô campsite, is considered as a group.
The accommodation offered on the Côté Ô Villages & Clubs website is intended exclusively for individual customers.
Any group reservation must be the subject of a written request and is subject to the agreement of Côté Ô Villages & Clubs.

4. Description
The photos and images used on the communication media are not contractual.

5. Tourist tax
The prices indicated are valid for the 2023 season. They correspond to one night and are expressed in euros, VAT included. The amount of the tourist tax varies according to the municipalities.

6. Payment conditions
For reservations made more than 30 days before the start of the stay, a deposit of 30% of the price of the amount of the services reserved must be paid upon reservation. The balance must be paid no later than 30 days before the start date of the stay.
For bookings made less than 30 days before the start date of the stay, full payment must be made at the time of booking.

Payment in several instalments, with Pledg
The Côté Ô Villages and Clubs GTCs apply to all bookings. In the case of a booking with payment in instalments, the mention “sums paid” corresponds to the sums committed to Pledg.

Payment of the stay in several instalments with Pledg, Côté Ô’s partner: Pledg offers a financing solution called Payment in 3, 4 or 6 instalments, which allows the order to be paid, without any limit of amount over 3, 4 or 6 months.

Subscription methods
When confirming the order, the Pledg partner offers to select the service of payment in several instalments to settle the stay. If the client wishes to subscribe to this option, his bank details will be transmitted to Pledg who, subject to acceptance of the file, will propose to the client to pay over 3, 4 or 6 months, and will indicate a payment schedule recapitulating the amount of the different monthly payments. Depending on the file, supporting documents may be requested from the customer to validate the financing request.

For payment in several instalments: as soon as Pledg accepts the application, the client must pay the first instalment. The client will be debited for the remaining instalments according to the payment schedule provided.

How does payment in instalments work?
The payment in several instalments allows the order placed on Côté Ô campsites website to be paid in the following way:

  • a compulsory deposit, debited on the day of confirmation of the booking, corresponding to part of the order
  • a distribution of the remainder of the order amount, over the number of remaining monthly payments, according to the payment schedule that will have been communicated.

7. Tranquility option
At the time of booking, the customer can subscribe to the tranquility option to benefit from flexible cancellation conditions, without justification. The offer is non-retroactive and can only be taken out on the day of booking. It must be paid at the time of booking. This offer does not replace the general terms and conditions of sale, it completes them as soon as the customer subscribes to it.

Terms of cancellation and refund of the stay:

  • Up to 15 days before arrival: refund of the sums paid minus the tranquility option
  • From 15 days before arrival: no refund can be made.

8. Cancellation insurance
Cancellation and interruption insurance is offered to the customer. The customer has the possibility to take out this insurance with the company Gritchen Affinity, partner of the company Côté Ô Villages & Clubs. The insurance premium must be paid in full when booking the stay and is non-refundable, unless the customer applies the provisions relating to the withdrawal period in terms of the insurance product. The premium is 3.5% of the basic amount. In the event of a claim, the customer must notify the insurance company within 5 days of its occurrence.
The general insurance conditions are available on request. Cancellation and interruption of stay insurance reimburses all sums paid (except excess, insurance subscription amount and administration fees) before arrival. In the event of an interruption of the stay, the customer will be refunded the price of the nights cancelled, adjusted pro rata temporis.
Any request for support is firm and final and results in the cancellation of the file. The customer will not be able to claim any compensation from the Côté Ô group or request that the reservation be kept in the event of refusal by the insurer.

9. Stay
Arrivals are from 4:00 p.m. for accommodations and from 2:00 p.m. for pitches. It is the customer’s responsibility to make an inventory (inventory and condition of equipment, state of cleanliness) of the accommodation within 24 hours of arrival. Any complaint must be presented to a representative of the campsite, on site. After this period, no complaint can be considered admissible.
No refund, even partial, will be granted by Côté Ô Villages & Clubs, in the event of an arrival outside the authorized hours, after the date of reservation or of an early departure of the customer.
If the customer does not show up the day after the scheduled day without having notified Côté Ô Villages & Clubs, by email, the latter runs the risk that his reservation will be canceled. Côté Ô Villages & Clubs is authorized to re-rent accommodation within 48 hours, without the customer being able to oppose it.
On handing over the keys, a deposit is requested from the customer.

During the stay
The customer is responsible for the surveillance of his personal belongings. Côté Ô Villages & Clubs declines all responsibility in the event of an incident involving the customer’s civil liability. All customers must comply with the provisions of the internal regulations. Each tenant in title is responsible for the disturbances and nuisances caused by the people staying in the same accommodation or pitch.

Departures are until 10:00 a.m. for accommodations
and until 12:00 p.m. for pitches. Rentals must be returned in perfect condition. Any item broken, damaged or missing will be the responsibility of the customer, as well as the restoration of the premises, if this proves necessary.
The deposit will be returned the day after the customer leaves, with a confirmation sent by email, less any compensation retained, on supporting invoices, for any damage noted by the inventory of fixtures. The withholding of the deposit does not exclude additional compensation if the costs exceed the amount of the deposit.
If the accommodation has not been cleaned before departure, a cleaning fee of a value of 100€ will be requested on the day of departure, or deducted from the deposit, if payment is not made. For any late departure, a fixed price may be charged at the rate of an additional night.

10. Cleaning
The cleaning and tidying up of the accommodation at the end of the stay is the responsibility of the customer:
– In the event that the customer benefits from an “End of stay cleaning” service (free or paid), this must return the accommodation in good general condition: accommodation tidied, dishes cleaned and tidied, bins emptied. Otherwise, Côté Ô Villages & Clubs reserves the right to charge the customer a cleaning supplement up to the total amount of the cleaning fee corresponding to the accommodation rented.
– In the event that the client does not benefit from an “End of stay cleaning” service, the latter is required to return the accommodation fully cleaned and tidy. If the client has not properly cleaned the accommodation before his departure, the host reserves the right to charge him a cleaning fee at the current rate, increased by 35 €.
Additional deposits for equipment may be requested by Côté Ô Villages & Clubs

11. Water parks
Access to our water parks is prohibited to:

  • Children under 10 years old not accompanied by an adult.
  • People who do not have suitable clothing for swimming: including swimming shorts, bermuda shorts or any other loose clothing not suitable for swimming are prohibited. The authorized outfits must be in Lycra and/or Neoprene and close to the body. Hats or caps can only be worn on pool decks but are prohibited when swimming. Only Lycra and/or Neoprene swimming caps are authorized in the pools.

12. Pets
Pets are accepted in Côté Ô Villages & Clubs campsites (except dogs of the 1st and 2nd category, as well as the NAC) for a supplement, to be paid when booking, on demand only.
Animals must be always kept on a leash. They are prohibited around swimming pools, in food stores and in buildings. It is forbidden to leave an animal alone in the accommodation. The vaccination record for dogs and cats must be up to date and may be requested on arrival. 1 animal per accommodation, any more must be requested.

13. Visitors
For all day visitors, Côté Ô Villages & Clubs may request the payment of a visitor tax. Visitors do not have access to aquatic centers or children’s clubs.

14. Image
The customer authorizes Côté Ô Villages & Clubs, to photograph, record or film him during his stay at Côté Ô Villages & Clubs and to use said images, sounds, videos, and recordings on all media (on Côté Ô Villages & Clubs websites or Internet pages, including Facebook, on the Côté Ô Villages & Clubs presentation and promotion media and on travel or tourist guides. This authorization is valid both for the client and for the people staying with him. Its sole purpose is to promote and run the establishments and the Côté Ô Villages & Clubs network and may not in any way damage the reputation of the client. This authorization is granted free of charge, for all countries and for a period of 5 years.

15. Moderation of opinions
The customer is informed and accepts that the opinions posted concerning the stays are used on promotional supports. In this case, the wording of the latter could be modified for the good understanding of all. On the other hand, the positive or negative direction will never be modified.

16. Complaints
Any possible complaint concerning non-compliance of services with contractual commitments must, as far as possible, be reported by the customer during his stay with Côté Ô Villages & Clubs. If it has not been possible to put an end to the non- conformity on the site, the customer can contact the manager of the campsite concerned by mail or e-mail or at the following address: Côté Ô Villages & Clubs, claims services, 22 rue Pasteur 33110 Le Bouscat.

17. Mediation
In the context of a dispute with one of the campsites of the Côté Ô Villages & Clubs group, the customer has the option of contacting Côté Ô Villages & Clubs as follows:
– Sending a registered letter with acknowledgment of reception to the manager of the campsite concerned.
– Sending a copy of this letter to customer service by post at Côté Ô Villages & Clubs – 22 rue Pasteur 33110 Le Bouscat.
If the response does not satisfy the customer, he or she can contact the Center CM2C mediation, after a period of one month following the sending of these letters / emails. You must submit a file online on the following website https://cm2c.net/ or by mail CM2C 14 rue Saint Jean 75017 Paris.

18. Responsibility of Côté Ô Villages & Clubs
No brochure and website can be immune to possible “typos”, omissions, or printing errors. Our prices are subject to change depending on economic and commercial conditions. Only the rental contract confirming the reservation is a contractual document.
All photos and texts used in the brochure or on the Côté Ô Villages & Clubs website are non-contractual. They are only indicative. It may happen that certain activities and facilities offered by Côté Ô Villages & Clubs and indicated in the description in the brochure are canceled, for climatic reasons or in the event of force majeure as defined by the French courts.

19. Information technology and freedom
The information that you communicate to us when placing your order will not be transmitted to any third party. This information will be considered by Côté Ô Villages & Clubs as confidential. They will be used only by the internal services of Côté Ô Villages & Clubs, to process your order and to strengthen and personalize the communication and the range of services reserved for Côté Ô Villages & Clubs customers according to your centers of interests. In accordance with the Data Protection Act of January 6, 1978, you have the right to access, rectify and oppose your personal data. 20. General rules
If one of the clauses of this contract is null and void by a change in legislation, regulations or by a court decision, this can in no way affect the validity and compliance with these general conditions. Any reservation is strictly personal to the customer who made it, so that the rights and obligations resulting from the contract cannot be transferred in any form whatsoever to third parties by the customer, with the prior written authorization of the company.
The client promises to respect and enforce respect of the interior Côté Ô rules, by the people occupying the accommodation or pitch. In the event of a serious or repeated breach of these provisions as well as these conditions, the participants of the stay may be asked to leave the Côté Ô Villages & Clubs before the end of their stay. In this case, no request for reimbursement or compensation will be accepted.
The customer is required to take out civil liability insurance with the insurance company of their choice.

21. Applicable law
These general conditions are governed by French law. Any dispute arising between the Parties, relating to the interpretation or execution of the contract of the latter which could not be resolved amicably by the parties, will be submitted to the competent court, except where such a provision is viewed as manifestly contrary to a public policy, notwithstanding a plurality of respondents or a guaranteed appeal.

22. Public liability
The customer lodged on a site or in an accommodation must be insured in civil liability. A certificate may be requested from the Customer before the start of the service.

23. General data protection regulation
The European data protection regulation n°2016-678 of 04/27/2016 obliges us to comply with the legislation relating to the protection of personal data.

Purpose of data collection
All the personal data whose communication is requested is necessary for the performance of the services of the residence permit. Failure to provide this information would therefore prevent the conclusion and / or execution of the residence permit.

Data limitation:
The information collected by the campsite is necessary for the execution of this stay voucher. The campsite will not process data for purposes other than the execution of said stay voucher.

Data transfer
Côté Ô Villages & Clubs undertakes to transfer this information only to internal departments and service providers or subcontractors involved in the stay. Personal data is as follow: civil status, address, telephone and numeric contact details, surname, first name and age of the participants, reservation elements and accommodation elements.

Security of personal data
Côté Ô Villages & Clubs takes all necessary precautions to preserve the security, confidentiality and integrity of the data collected and any misuse of this data.

Rights of data subjects
The customer has the right to exercise, in the cases defined by the regulations: rights of access, rights of rectification, rights of deletion, rights of portability, relating to the data concerning you as well as the right to request the limitation or to oppose the treatment. These rights can be exercised by contacting Pascale ESPAILLARD on +33 5 35 54 68 30 acting as RGPD representative for Côté Ô Villages & Clubs.

Retention of data
The personal data collected as part of this residence contract and its execution will be stored 2 years at the end of the stay, excluding time required for the exercise or defense of the camp for its rights in court if such action were taken.
